Alaska Governor Sean Parnell said he won't implement the federal health-care overhaul after a judge in Florida struck down the law as unconstitutional.
It's not immediately clear what practical impact the unusual move would have on Alaskans, an estimated 14% of which are uninsured year-round. A major expansion of the federal law is still pending, and a legal expert and health-care consumer advocate say any refusal by the states to participate in the law is an invitation to the federal government to step in and implement it for them.
Mr. Parnell, who sought the advice of his attorney general amid concerns implementing the law would violate his oath of office, told the Juneau Chamber of Commerce the state would pursue lawful, market-based solutions to making insurance affordable and accessible to Alaskans.
He said the Florida judge's ruling is the law of the land, as it pertains to Alaska, barring implementation of the federal law here. He said the state will pursue options of its own instead.
Alaska was one of 26 states that were party to the Florida lawsuit; however, in other cases, two federal judges have upheld the law and one judge ruled a provision requiring citizens to buy health insurance or face penalties—a major point of contention in the Florida case—is unconstitutional but did not strike down the rest of the law...
Writing in The Washington Times, a practicing Kansas MD -and Obama's own second cousin- Dr Milton Wolf had advocated this very strategy for states earlier in the week:
"...the states should declare their own moratorium on implementation of Obamacare until the Supreme Court offers its ruling on the president’s health care overhaul."
At minimum, it's nice to see somebody with some backbone like Alaska Governor Sean Parnell standing up to this heinous regime... alas, in the end all will be resolved only by SCOTUS. But I dare any of the libs on that court to explain how the Constitution allows for mandatory purchase of a good or service- and with heavy-handed IRS enforcement, no less! There's no grey area there, please.
ObamaCare looks to be on the verge of defunding by GOP legislators as well... death by 1000 cuts as good as repeal for now, but somehow, someway... ObamaCare must be destroyed.

The decision by the judge in Virginia that the mandate to force people to buy Obamacare in unconstitutional is great news. Of course we all knew Obamacare was unlawful, but we do need the courts to protect us. What other goods and services could the government force us to buy if this were allowed to stand?
Stalling any and all implementation is essential. We will lose doctors immediately once doctors find they can no longer pay their overhead and keep their offices open.

This is nasty stuff and an obvious attempt to shift political blame for rising insurance costs before the election. It’s also an early sign of life under ObamaCare, when all health-care decisions are political and the bureaucrats decide who can charge how much for a service or product.
Oh, don't worry. There is no government takeover of Health Care. Sen. Kent Conrad says so.

Let's make it a Hell NOvember for the fans of Obamacare. Yes, Obamacare. The gift that keeps on giving. American employers are already scared to hire new workers, in good part because of the burdens of Obamacare. Additionally, the 1099 reporting requirements will crush small business under an avalanche of tax paperwork. Can you imagine sending a 1099 form to Staples or the computer store? Yep. Wherever you spent more than $600, you will have to send a 1099 tax form, after scrambling around to find out the taxpayer ID number for each of these retail outlets. Nightmare!

State and university employees with families can expect to see their monthly health-insurance costs rise as much as 37 percent next year, depending on the type of plan they choose.
Figures provided by the Arizona Department of Administration show that health plans for families and single adults with children will shoulder the most-expensive monthly premium increases beginning Jan. 1, while individuals will pay modest increases.
The Department of Administration cited federal health reform as the reason the state's health plans will carry "greater expenses and higher premiums for members," according to a June 30 letter sent to about 135,000 state and university employees and their dependents.
The letter named two provisions that the state expects will drive health-insurance costs higher. One is a requirement that insurance plans provide coverage for dependent children up to age 26. The other is the federal legislation's ban on lifetime limits, an insurance-industry practice that cuts coverage once an individual's medical expenses exceed a set amount over their lifetime.

I have to tell you that I have wondered why physicians didn't speak out more loudly against Obamacare this past year. I still don't understand why the American Medical Association endorsed it. I understand that the AMA represents less than 30% of all physicians. But why would they sell out their members so completely. Almost like the AARP endorsement throwing seniors under the bus. As if someone has been Bought Off.
To actually DO something about Obamacare, I suppose they had to wait until it became law. And now the AAPS, the Association of American Physicians and Surgeons, has filed suit in U.S. District Court for the District of Columbia (AAPS v. Sebelius et al.).
“If the PPACA (Obamacare) goes unchallenged, then it spells the end of freedom in medicine as we know it,” observed Jane Orient, M.D., the Executive Director of AAPS. “Courts should not allow this massive intrusion into the practice of medicine and the rights of patients.”
“There will be a dire shortage of physicians if the PPACA becomes effective and is not overturned by the courts.”
The PPACA requires most Americans to buy government-approved insurance starting in 2014, or face stiff penalties. Insurance company executives will be enriched by this requirement, but it violates the Fifth Amendment protection against the government forcing one person to pay cash to another. AAPS is the first to assert this important constitutional claim.
The PPACA also violates the Tenth Amendment, the Commerce Clause, and the provisions authorizing taxation. The Taxing and Spending power cannot be invoked, as the premiums go to private insurance companies. The traditional sovereignty of the States over the practice of medicine is destroyed by the PPACA.
I hope the physicians and the 14 states that are suing against Obamacare are successful. There are other ways to reform health care without gutting the best health care system in the world.
